The December Meeting
Jim Gibbons Quits, Paul appoints Dick Herschel, Extraordinary
Board Powers.
Jim Gibbons did not attend. Paul, Earl, Carol and Omar were present.
The audience was made up of Don and Dottie Riebe, Tony Esporma, Charlie
Oliver, Mike Barber, Lou Shaver and Jasmin Kadaster.
Homeowners Forum:
Dottie Riebe: Two grown men were observed to be urinating in
the Grossmont park in the middle of the day.
Tony Esporma: The City codes and Association CCRs are in conflict.
The city has identified a possible 15 or so homes in violation of front
structures. Furthermore, many more homeowners may be in violation
of Sight Distances with overgrown bushes and plants. The city found
this out when someone complained to the city about Tony's front fence which
was built with Board approval. It costs upwards of $800.00 per homeowner
to try to get a waiver to keep the offending structure or bush.
Don Riebe: Why is the association newsletter using member lot
numbers instead of real names in the newsletter? The board replied
that this is done to protect it from liability. A discussion ensued
but no one seemed to agree. According to Jason Cleveland, members
at the meeting can request that their names be used instead.
Mike Barber: The city is progressing with plans to widen Culver.
It has yet to be decided whether to shut it down completely for six months
or just one side at a time. According to Edwin, Mike Barber is also
involved in this issue. Jason reported that Carol Schroeder (sp?)
over at the city is coordinating this.
Old Business
Lights over at Emporia and Grossmont Park. It was agreed
to have Jason get a bid to do all the lights using galvanized steel supports
since they are stronger, last longer and their additional cost is negligible.
Swing Sets over at Emporia Park. According to Jason there's
not enough room to put in the additional swings unless either the walkway
is moved or the maze is cut back. The board instructed Jason to get
a more complete estimate -preliminary numbers thrown around were up to
$5000.00. Once the numbers are known then they can be published in
the newsletter.
Walls. According to Jason, we have an estimate to fix
the Riebe's wall alongside Turtle Rock Dr. it by fixing just a few blocks.
According to the Riebes, they have an estimate which calls for replacement
of the entire wall. This wall is over 30 years old and they are concerned
that it may fall on some school children on their way to and fro Turtle
Rock Elementary.
Jason recommended that a new survey be made to inspect all walls
since the last one is now three years old. Omar questioned the need
for a new survey, what could have changed? he asked. Jason
pointed out that mortar and cement ages with time, that we had some heavy
rains two years ago and that the ground shifts -as has occurred with a
wall along Culver. The Board decided against a new survey but asked
Jason to get new estimates to fix both the Riebe's and Culver walls.
Approvals:
Member #25 -we sound like robots don't we?- approved for new
roof, door and windows.
Landscaping
Three hundred dollars were approved. $150.00 to plant flowers
on an association owned bank on Hirum. Another $150.00 to plant flowers
on the entries to Grossmont and Emporia.
New Business:
New Director Appointed. Paul Jones noted that Jim Gibbons
unexpectedly resigned from the board just two weeks after an election with
nine candidates. He asked Jason for clarification on what powers did the
board have on such occasion. After that he presented Dick Herschel
to the Board as a candidate. The Board approved him and placed him
in charge of painting. All other members retained their positions.
A committee to review the CCRs. Paul Jones has solicited
the help of four members of the association to form a committee steered
by a board director to work on bringing the CCRs into conformance with
current laws. The panel is made up of Earl as chair, Charlie Oliver,
Fumiko Takemura, Leo Proceatto (sp?) and Elmer Bickerstaff (sp again?).
The board is to explore such things as banners, flags, remodeling etc...
A draft is expected within six months and final recommendations in eight
months from now.
Extraordinary Powers of the Board. According to Jason,
the Broadmoor Board has powers not normally allowed other Homeowner Boards.
Our Board can actually change the CCRs in some instances without a vote
from the association membership. Hence, Paul sanctioned the CCR committee
to break down the changes of the CCRs into two camps: 'noncontroversial'
and 'controversial'. The former will be voted on solely by the board
and such changes will be incorporated by an administrative procedure.
'Controversial' items shall be put to vote to the membership at large.
If not enough votes are cast -in total- then the board will take the changes
to a court of law to seek judgment that validates the changes to the CCRs.
In essence this means that the membership can not 'pocket veto' changes
to the CCRs. Any legal changes will be spread over a two year fiscal
period to minimize their impact on the finances.
